Governor Ifeanyi Ugwuanyi, Enugu State Attorney General and ESNIEC dragged to court over

CourtA legal practitioner, Mr. Alex Amujiogu and the All Progressives Grand Alliance APGA, Enugu State Chapter on Tuesday, 2rd February, 2016 dragged the Enugu State Independent Electoral Commission ENSIEC, to an Enugu High court for failure to conduct Local Government Elections.
They also dragged the State Governor, Chief Ifeanyi Ugwuanyi and the State Attorney General and Commissioner for Justice, Chief Melitus Eze to court for setting up of caretaker committees to handle Local Government administrations in the area.
 
The applicants are seeking the leave of the court to declare the caretaker committees unconstitutional and illegal.
They are also seeking leave for an order of mandamus to compel ENSIEC to conduct local government elections in the state.
 
This is in addition to leave for an order to prohibit the caretaker committees from taking further actions in the local government areas.
The first applicant, Mr. Alex Amujiogu while addressing the court said that “Section seven of the constitution of Nigeria had made it clear and unequivocal that local government election can only be governed by duly elected council members and not by appointed caretakers which is an aberration under the law for the government to do so. And we are also seeking for an order of mandamus to compel ENSIEC to conduct local government election in Enugu State because it is their duty to do so and the court should compel them to so.”

The presiding Judge, Justice Ruben Onuora granted the applicants leave to argue the merit of the matter on the 23 February, 2016 which is the adjourned date.
Correspondent Chukwubuike Madu reports that the adjournment is to enable the respondents to appear before the court to defend their actions and inaction.
